The terms and conditions governing your use of our website and vehicle shipping services across the United States and Canada.
Welcome to ShipThat. These Terms of Service ("Terms") govern your access to and use of the shipthat.net website (the "Site") and the vehicle shipping services provided by ShipThat ("we," "us," or "our"). By accessing our Site or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
Overview of Services
ShipThat is a vehicle shipping brokerage that connects customers with licensed and insured motor carriers for the transport of recreational and personal vehicles, including boats, cars, ATVs, snowmobiles, and RVs, across the United States and Canada. We coordinate logistics, provide quotes, and manage communication between you and the carrier. ShipThat does not physically transport vehicles; transport is performed by independent carrier partners.
Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use our services. By placing an order or requesting a quote, you represent that you meet these requirements and that all information you provide is accurate and complete.
Quotes and Pricing
- All quotes provided through our Site are estimates based on the information you supply, including vehicle type, dimensions, weight, pickup and delivery locations, and preferred shipping dates.
- Final pricing may vary based on actual vehicle condition, route availability, fuel surcharges, seasonal demand, and other factors. We will notify you of any price changes before proceeding.
- Quotes are valid for 7 days from the date issued unless otherwise stated.
- All prices are quoted in US dollars (USD) unless otherwise specified for Canadian shipments.
Booking and Orders
- A booking is confirmed once you accept a quote, agree to these Terms, and provide the required deposit or payment as specified.
- You are responsible for ensuring the accuracy of all order details, including vehicle information, pickup and delivery addresses, and contact information.
- Pickup and delivery dates are estimates and not guaranteed. Delays may occur due to weather, road conditions, carrier availability, mechanical issues, or other circumstances beyond our control.
- You or your designated representative must be present at both pickup and delivery to inspect the vehicle and sign the Bill of Lading.
Customer Responsibilities
By using our services, you agree to:
- Provide accurate and complete information about the vehicle being shipped, including any modifications, non-functional components, or damage.
- Ensure the vehicle is in operable condition unless you have arranged for inoperable vehicle transport (additional fees may apply).
- Remove all personal belongings from the vehicle before pickup. ShipThat and its carriers are not responsible for personal items left in the vehicle.
- Ensure the vehicle has no more than a quarter tank of fuel at the time of pickup.
- Disable or remove aftermarket alarms, toll transponders, and parking passes.
- Provide clear, accessible pickup and delivery locations suitable for transport equipment.
- Notify us of any special requirements, including enclosed transport needs or oversized vehicle considerations.
Cancellation and Refund Policy
- You may cancel your order at no charge if cancellation is made more than 48 hours before the scheduled pickup date.
- Cancellations made within 48 hours of the scheduled pickup may be subject to a cancellation fee to cover carrier scheduling costs.
- If a carrier has already been dispatched, cancellation fees may include the carrier's incurred expenses.
- Refunds, when applicable, will be processed within 10 business days to the original payment method.
- ShipThat reserves the right to cancel an order if the vehicle or shipping circumstances differ materially from what was described at the time of booking.
Insurance and Liability
- All carrier partners used by ShipThat are required to carry valid cargo insurance as mandated by the Federal Motor Carrier Safety Administration (FMCSA) and/or applicable Canadian transportation authorities.
- Insurance coverage applies to damage that occurs during the loading, transport, and unloading of your vehicle. You must note any damage on the Bill of Lading at the time of delivery to file a claim.
- ShipThat acts as a broker and is not directly liable for damage, loss, or delays caused by the carrier. Claims for damage must be filed with the carrier, and we will assist you with the claims process.
- We strongly recommend that you photograph your vehicle thoroughly before pickup and upon delivery.
- ShipThat is not liable for damage caused by acts of nature, road debris, or other circumstances beyond the carrier's control.
- Personal belongings left inside the vehicle are not covered by carrier insurance.
Bill of Lading
The Bill of Lading (BOL) is the official document that records the condition of your vehicle at the time of pickup and delivery. It is critical that you or your representative carefully inspect the vehicle at both ends and accurately note any existing or new damage on the BOL. Failure to document damage on the BOL may affect your ability to file a successful claim.
Cross-Border Shipments (US & Canada)
- For shipments crossing the US-Canada border, you are responsible for ensuring compliance with all applicable customs regulations, import/export requirements, and vehicle standards for the destination country.
- Additional fees may apply for customs brokerage, duties, taxes, or inspections. These fees are the customer's responsibility and are not included in the shipping quote unless explicitly stated.
- ShipThat will provide guidance on cross-border requirements, but it is ultimately your responsibility to ensure all documentation is complete and accurate.
- Delays at the border due to incomplete documentation or customs holds are not the responsibility of ShipThat or the carrier.
Prohibited Items
The following items may not be shipped inside or with the vehicle:
- Firearms, ammunition, or explosives
- Hazardous materials (as defined by the DOT)
- Illegal substances or contraband
- Live animals or plants
- Perishable goods
- High-value items such as jewelry, cash, or important documents
ShipThat and its carriers reserve the right to refuse transport of any vehicle containing prohibited items. Discovery of prohibited items may result in immediate cancellation without refund.
Intellectual Property
All content on the Site — including text, graphics, logos, images, and software — is the property of ShipThat or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our Site without our prior written consent.
Use of the Site
By using our Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt the operation of the Site or its servers
- Attempt to gain unauthorized access to any portion of the Site
- Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission
- Impersonate another person or entity
We reserve the right to suspend or terminate your access to the Site at our discretion if we believe you have violated these Terms.
Disclaimer of Warranties
The Site and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ShipThat does not warrant that the Site will be uninterrupted, error-free, or secure. We make no representations about the accuracy or completeness of the content on the Site.
Limitation of Liability
To the fullest extent permitted by law, ShipThat and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or services, including but not limited to loss of revenue, data, or use, whether in an action in contract, tort, or otherwise. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid to ShipThat for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless ShipThat, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or services, your violation of these Terms, or your violation of any rights of a third party.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from or related to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
Modifications to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site or services after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
